Information for the Contractual Partners on Processing of Personal Data

The company MEDIATE s.r.o., ID: 647 91 866, with registered office at Dolní Libchavy 325, 561 16 Libchavy, Czech Republic, registered in the commercial register kept at the Regional Court in Hradec Králové under the reference number C 9702 (hereinafter referred to as the „Controller”), from the position of a Data Controller, hereby would like to inform the contractual partner, if he is a natural person, as a data subject, that his personal data will be processed as follows:

1. 1.       In order to fulfil the legal obligations of the Controller, the following personal data of the contractual partner will be processed:

Name and surname or name, address of residence or registered office, identification number, tax identification number, date of birth, eventually birth number, scope and subject of performance, or other mandatory data according to the relevant legal regulations

These personal data will be processed, in particular, to meet the obligations of the Controller arising from applicable legal regulations (e.g. in the field of bookkeeping). Personal data may be transferred by the Controller to third parties, to the public authorities in particular, if the Controller is legally obliged to provide these personal data. Personal data will be processed for as long as is necessary to meet the legal obligations that apply to the Controller.

1. 2.       For the performance of the contract, of which the contractual partner is the contracting party, the following personal data of the contractual partner will be processed:

Name and surname or name, address of residence or registered office, delivery address, identification number, tax identification number, date of birth, eventually birth number, e-mail address, telephone number, bank details, or other data provided by the contractual partner for this reason

These personal data will be processed for the purpose of performing the contract in particular, i.e. the exercise of rights and fulfilment of the obligations arising to the Controller from the contract. Personal data of the contractual partners may be transferred to other contractual partners of the Controller, e.g. to the transport companies in order to deliver goods.  For the duration of the rights and obligations under the contract to which the contractor is a contractual party, the Controller processes the personal data necessary to perform the contract, including the related rights, for example, for the purpose of exercising the rights arising from the liability for defects. These personal data will also be processed due to the necessary measures being taken before the conclusion of a contract at the request of a potential contractual partner. Personal data will be processed for a contract negotiation purposes. Personal data will be processed until the conclusion of a contract negotiation process.

1. 3.       Due to the legitimate interests of the Controller, the following personal data of the contractual partner will be processed:

Name and surname or name, address of residence or registered office, e-mail address, telephone number, identification number, tax identification number, date of birth, eventually birth number, scope and subject of performance, or any other information provided by the contractual partner for this reason

These personal data will be processed, in particular, for the purpose of recovering any claims by the Controller, and in order to addressing the contractual partner, with whom a contract has been concluded already, with an offer to conclude a new contract with the Controller. The personal data of the contractual partner will be processed for these purposes for the time necessary to exercise legitimate interests of the Controller.

The Controller informs that if the contractual partner is a legal entity, the Controller will process the personal data of a natural person acting in specific cases on behalf of this legal entity, namely for the reasons stated above and in the scope of name and surname, job position, or e-mail address and telephone number.

The Controller would like to inform the contractual partner that the above mentioned personal data may also be processed, on behalf of the Controller, also by the Processor, as an entity other than the Controller (for example, with regard to providing of technical support, advice, security of the Controller's asset, etc.). The Controller shall, on request, communicate to the contractual partner the identity of the Processors to whom the personal data were provided.

The processing of personal data obtained from all the contractual partners of the Controller is carried out in accordance with Act No. 101/2000 Czech Coll., on the protection of personal data, as amended (hereinafter referred to as „the Act“) and Regulation of the European Parliament and of the Council (EU) 2016/679 of 27th of April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, in the version in force since 25th May 2018 (hereinafter referred to as „the Regulation“).

The contractual partner is entitled to require the Controller to access his / her personal data, that is to say he / she has the right to request the issuance of a confirmation that his / her personal data are being processed and the right to ask for information about the progress of the processing, and in addition, the contractual partner has the right to the portability of personal data. The contractual partner may request a correction if the personal data are inaccurate or if the personal data are incomplete. The contractual partner may object, request the deletion and limitation of the processing of personal data only by the reasons stated by the Law or the Regulation.

In case of doubt about compliance of the Controller with the obligations, the contractual partner can reach the Controller on + 420 465 524 547 or at e-mail address info@apotheke.cz and, if needed, to file a complaint with the Office for Personal Data Protection.

In this way, the contractual partner was informed about the rights under the law and regulations, and he / she was informed of what personal data, for what purpose, and for how long will be processed by the Controller.
